The average consumer is bombarded with somewhere between 500 and 1300 advertising messages per day. If you doubt that, think about it for a moment. When we get up in the morning, most of us typically turn on the television and listen to the news or a talk show while we get ready for work. During that half-hour or so, there will be anywhere from 15 to 25 commercials. Now, we may not consciously pay attention to each - - or any - - of those commercials. However, the reality of it is, that our subconscious mind will pick up some information anyway. We may also take time to read the paper as we eat our breakfast. As we do so, we will likely pass anywhere between five and 15 additional advertisements; some of which will seep through our mind. As we drive to work, many of us will have on our radios where we will be hit with another 10 to 15 ads. Also, as we drive, we will be exposed to billboards, signage, business logos, advertisements on other vehicles, etc. which will add another 10 to 20 ads. That makes anywhere between 40 and 60 ads we could be exposed to in less than one hour, which averages 50 advertisements. Now multiply that by the average number of hours Americans remain awake and you get 800 advertising messages. If you take into consideration other activities in which we partake like reading magazines, going to the movies, taking part in some kind of leisure activity, or surfing the Internet, you can easily see how we are exposed to so many advertising messages on any given day.

Unfortunately, a lot of the messages that we are being exposed to are less than honest. False advertising has once again become a regular main stay in today's world. A good example of this comes in the form of weight loss supplements. They proclaim "take these pills and you will lose weight 30 percent faster without diet or exercise." Others say, "these pills work uniquely with a woman's body to increase the amount of weight loss." Exercise programs are nearly as bad. Think about those wonderful ab belts that are supposed to "help you lose inches around your waist and firm your abs without sit-ups or crunches." Or how about those expensive exercise systems that "guarantee if you're not happy, we will refund your money." Has anyone ever really tried to get his or her money back on one of those?

I'm as guilty as the next one in looking for an easy way to lose weight and firm and tone my sagging, dragging, nearly 60-year-old body. And I will admit that about 95 percent of all of the diet programs and exercise efforts that I have used were of absolutely no value at all. In actuality, I have only found one eating system (not really a diet, per se) and one piece of exercise equipment that ever worked for me: Suzanne Somer's "Somersize" eating program and her "Torso Track" exercise equipment helped me to lose 75 pounds in less than four months. The bonus was that I actually felt great doing it and I was in the best health - - and shape - - of my life. Still, more often than not such programs are a complete scam. Don't even get me started on Michael Thurmond's Body Blueprint Program

Now take that one example - - diet and exercise - - and multiply it by the thousands of other deceptive and false advertisements that we are exposed to every single day. Realistically can Tylenol, Aleeve, Advil, and Excedrin all be the best headache medicine? They claim they are. Is Crest, Colgate, or AquaFresh the toothpaste recommended by dentists? According to each of them, they all are. Does DuraCell or Ever Ready make the longest running battery? According to them, they both do. Is Pepsi or Coke America's favorite soft drink? Both say they are. Deception in advertising has once again become so rampant that most Americans just throw up their hands in despair.

Two conflicting principles are involved in advertising law which might help us better understand this state of confusion. While it is true that the First Amendment grants the right of free speech and protects all forms of communication, including advertising, the U.S. Constitution gives the federal government the power to regulate interstate commerce. In doing so, Congress enacted two statutes that effect advertising. The first is the Federal Trade Commission Act. The second is the Lanham Act.

The Federal Trade Commission Act states that false advertising is a form of unfair and deceptive commerce (which trumps the First Amendment). In reality, while the act obviously includes advertisements that are untrue, it is also broad enough to encompass ads that make representations that no one has a reasonable basis to believe. The act also gives the Federal Trade Commission broad authority to regulate advertising which could include the barring of advertisements that are misleading or the right to order that ads be run to correct deceptions.

In order to establish a violation under the Lanham Act, consumers or competitors must prove the following:
  • The advertiser made false statements of fact about its product;
  • The false advertisements deceived or could deceive a substantial segment of the target population;
  • The deception was material;
  • The falsely advertised product was sold in interstate commerce; and
  • The party bringing the lawsuit was injured as a result of the deception.

With these two acts in place, one must wonder why so much false advertising continues to take place. The answer is simple: Because we let companies get away with it!

Consumers have become so jaded that they really no longer believe any advertising claim that they hear. Some would ask why that is a problem. If consumers disbelieve everyone, then they are less likely to get hurt. Wrong! There are actually some scrupulous companies out there who strive to be honest and tell the truth. However, many of them will not remain in business for long because the bigger companies with the deeper advertising pockets can out-fox, out-maneuver, and out-advertise the good guys. The end result is that the consumer is, once again, being used.

The solution to this problem is also simple. Stop letting the bad guys get away with it. Complain, bitch, scream, write letters, file claims; do whatever you can to put a stop to this deceptive and unfair practice. The Federal Trade Commission welcomes calls, emails, and letters of complaint from the general public. Best of all, they are pretty good at their job. I know this because when I worked for the Oklahoma Small Business Development Center, I worked with inventors. There are a ton of agencies out there who are specifically set up to take advantage of inventors and most of my clients ran into at least one of them. Only through complaints filed through the FTC were these wonderful, creative people able to recover the thousands of dollars paid to fake invention companies. The moral of the story is: This is a system that works! We just have to use it.

I wish that Ralph Nader was still doing what he once did so well, instead of getting involved in the political arena. Nader's Raiders were responsible for uncovering hundreds of such fake schemes as well as helping to get the truth in advertising acts that we now have in place. Unfortunately, there is no one picking up that banner in this day and age. Therefore, we have to do it for ourselves.

Making Money Through

A version of this column is scheduled to be published in The Washington Times, Monday, July 11, 2011.

Follow the Money No. 74: Charlie Chaplin’s suit?

The geopolitical question of the hour: is there a tripwire that will tie together a series of regional crises bringing on another 2007-08 worldwide economic disaster?

Lehman Brothers’ collapse dramatized how enhanced interconnections can tumble through the new world economy with domino effect. But if the world finance mavim know a seminal interrelation of our several bubbling crises, they are not telling us. Meanwhile, the minitheaters percolate:

Europe –There’s growing consensus Greece’s economic collapse is leading to a restructuring of the European Union’s finances with more than 20% of the world’s gross product. Shooting the messenger – the growing attacks on rating agencies which, indeed, are feeding debilitating increases in the cost of debt – doesn’t solve the problem nor do complicated if band-aid solutions. Nor, does it seem likely to this observer, creation of a Eurobond market to absorb growing debt would automatically bring about inspired, problem-solving central European fiscal and monetary direction. [It didn’t with creation of the Euro “common currency”.]

The U.S. – However much the Obama Administration’s stimulus program staved off an even worse crisis – to be argued until the end of the economists’ time, not soon contrary to John Maynard Keynes hopeful prediction the profession would die out – it has run out its string. Public opinion demands curbing deficit spending. But how against pressures of “special interests” [yours’ always are, mine are heaven blessed] is a conundrum taxing the American political system. It‘s a time when parliamentary government – with its ability to bring down a cabinet’s failed strategy instantaneously – is envied. Instead, more than a year’s political mudslinging appears inevitably producing near paralysis. Meanwhile despite widespread denials – including fudging with inventions like “core inflation” – higher prices could couple with stubborn underdemployment/unemployment and an unresolved housing bubble for increasing misery.

China – The cracks, long seen by the few who questioned sustainability of the miracle of “the world’s factory”, are widening. Beijing central planners – despite their rationale only rapid growth could legitimate “Communism with Chinese characteristics” by providing jobs and stability -- have curbed unlimited infrastructure expansion which with now slowing exports was the engine of growth. “Creative accounting” takes on new meaning for government banks hiding “non-performing loans” in new set-aside organs now making their own bad loans. Beijing’s inability to “feed” local Party hacks leads them to “squeeze” workers and farmers in turn leading to growing violence. Inflation, especially food where most Chinese live, grows despite monetary devices borrowed from Western systems largely ineffective on what still is a Soviet skeleton.

Japan – The world’s third largest economic power drifts, mysteriously bereft of political leadership, caricatured in its inability to address the destruction of the earthquake-tsunami with characteristic “Yamato Damishi” [fortitude]. In Japan’s hot, muggy summer, only 19 of 54 reactors are operating in the face of anti-nuclear sentiment. With more to shut down, cutbacks of 15% already haunt large electricity customers and boosts expensive fossil fuel imports. Consumer confidence falls to record lows, ominous for Japan’s rapidly ageing population. Government debt, already the world's highest ratio at 200% of GDP, will rise as Tokyo borrows $100 billion to rebuild and GDP shrinks. Luckily, Tokyo borrows at home at floor-scraping 1.5%. But, Japan, too, has its echo of the American argument: Economy Minister Kaoru Yosano opposes Tokyo selling itself bonds as the Fed and Treasury have done, warning resulting higher finance charges would hit Japanese banks.

But how does it all connect? We saw how Japan’s disaster put a crimp in the manufacturing supply chain from Shanghai to Detroit. But, for example, what call have German and other European banks on their U.S. colleagues if Greece defaults? Japan, which has been lending the world $175 billion annually in investment capital, is out of that business. Nobody wants to talk about the impact on Spain [20% of the EU GDP] if Greece [3% of the EU GDP], followed by Portugal and perhaps Ireland, “goes”. What will that do to Latin America where Spanish banks have invested heavily as the Brazilian boom simultaneously now threatens to go “bust”? Australia’s roaring dollar is already feeling Chinese cutbacks as will all commodities producers, perhaps even the Mideast petrosheikhs.

In one of his serio-comic sequences, Charlie Chaplin’s little tramp starts pulling a thread from his crumpled suit. Before long, his whole miserable costume dissolves. Is there that kind of loose thread here?

Banks Cashing In On Data

If a person's primary method of payment is some type of credit or debit card, the banks know everywhere that person goes, what they spend their money on, what their preferences are, what locations they frequent and so on.

Selling that data is an interesting method of making money for banks. Federal regulations are strict on what customer data banks can share and with what entities. According to the Tribune story, the bank's system is set up in such a way that the deals are coming from the bank, not from the merchant. Data is processed between the merchants and the banks through intermediaries, such as Cartera or Cardlytics. Personally identifiable information is randomized and customers are given numeric codes, of which only the bank will know who the user truly is.

According to the Tribune, 58% of customers have redeemed at least one deal. The incentive programs are opt-out, which 2% of customers have chosen to do. Merchant funded incentive programs could be a $1.7 billion vertical for the banking industry by 2015, even with the banks only taking 25% of the fee for the incentive.

Privacy, Data, Money = Advantage Banks

Opt-in or opt-out is a tricky question when it comes to data and privacy. Companies like Facebook have gotten into hot water with privacy advocates by making changes to their privacy policy and settings opt-out in a way or place that a lot of users will not notice or check. Think of it this way - are you getting offers from your bank? Did you remember the bank asking you if it could share your information or was it in the fine print of your cardholder's agreement somewhere?

When it comes to the Internet, money is inextricably tied to user data. The companies with the most data about their users tend to make the most money. Banks are the perfect avenue for incentivized deals because they can offer merchants exactly what they are looking for.

For instance, a 29-year-old male with an income above $40,000 that purchases shoes three times a year would be a perfect target for a deal from Designer Shoe Warehouse or Footlocker. Groupon cannot give merchants that level of granular information.

What will this mean for the fledgling daily deals industry going forward? Groupon had a litany of risk factors in its filing for its initial public offering and "inability to stave off competition and clones" was one of them. Facebook and Google are secondary players in this market. Both have created various types of deals and "offer" campaigns, and they both pose a problem to the primary players since they already have significant amounts of user data.

Yet, the banks have more information about customers than any Internet company ever could. If the financial industry starts muscling into deals, do the likes of Groupon and LivingSocial stand a chance?

Making Money

The U.S. government's approach to secure online identities, with its strong emphasis on privacy, is to be applauded. But the devil is in the details. In this case, the details lie with the private sector, whom the administration intends to rely on to provide solutions.

This gets sticky. Businesses exist to make money. While search is used to target ads, data from social networking sites enables even better targeting. Just look at the financial expectations on Facebook. Social networking sites find a great deal of value in being your identity provider everywhere you visit. Some social networking sites go one step further: they not only authenticate you to a site -- Facebook telling the relying party (such as the New York Times) who you are --- but they also share other demographic information about you, like where else you've been, with the parties to whom they've provided the authentication. Such information sharing is quite valuable to these relying parties. It's part of what has propelled the identity tools to be such strong players. But it means that not only does your identity provider know everything about you, so do the relying parties.

Now the federal government has taken a wise step. Under the Federal Information, Credential, Access Management roadmap (now there's a mouthful!), no identity provider for the federal civilian agencies can share such relying party information or even use it themselves (e.g., to better targets ads). The technical term is activity tracking, and federal rules are that identity providers aren't allowed to track your activity while you're on federal sites. What that means is if a Facebook user uses their Facebook credential to log into IRS to obtain tax information, Facebook can't share the fact that the user went to IRS -- or what information they obtained there -- with any other site. In fact, Facebook can't even add that information to their own user profile. That's terrific for privacy.

But if identity providers are all in the business to make money, why should Facebook -- or any other private company -- be willing to act as an identity provider for federal sites? After all, they can't use the information they've learned (and in the U.S. economics drives all). The answer is a funny thing called user stickiness. Users do what's easy. If Facebook won't serve as an identity provider for a U.S. government website, then the user has to change providers when she wants to access that website. And changing providers in the middle of a session might mean that a user doesn't go back to using their Facebook credential after the transaction. Facebook doesn't want to lose her during the web session. So various identity providers are willing to act as identity providers for U.S. government sites even if the providers can't make use of the information they've learned.

There's a lesson here for other sites, sites that ought to be in the business of protecting your privacy. What articles I read at the Huffington Post or Fox News, what pages I view at the he Mayo Clinic or the American Heart Association, ought to be private between me and those sites. They should not be shared with other relying parties or used by an identity provider for its own purposes. Those sensitive sites, the ones that have important reasons (such as protecting the First Amendment right to read anonymously) should adopt the same rules regarding activity tracking as the federal civilian agencies have done. Because there are still many sites that provide economic value to these identity providers, such a change wouldn't stop identity providers from providing their product across the network. But it sure would make a difference in protecting privacy where it matters.
